After BM 7 was approved, the City of Portland
did adopt a procedure for the processing of claims. You might want to
get a hold of a copy of that ordinance. I am sure that this will be a
major topic of discussion at the LOC.
My recommendation to our City Council will be that we preemptively adopt a policy of waiving challenged regulations provided the claims are valid. This policy would be based on the fact that the City simply does not have sufficient funds to be making payments and because the case by case payment decision option is inherently arbitrary and therefore politically awkward in the extreme. When the neighbors then start calling we will be suggesting that they contact our state representatives to fix it.
